1. Acceptance of Terms

By accessing or using any website, platform, or service operated by Obseq Inc. (“Obseq”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please discontinue use immediately.

2. About Obseq

Obseq is a financial technology company providing global payment infrastructure, liquidity solutions, and settlement services to institutional clients and partners. Our services are intended for businesses and qualified counterparties, not retail consumers, unless expressly stated otherwise.

3. Use of Services

Access to and use of Obseq’s services is subject to applicable onboarding, compliance, and contractual requirements. By engaging with our platform or services, you represent that:

• You have the legal authority to enter into binding agreements on behalf of yourself or your organisation
• Your use of the services complies with all applicable laws and regulations in your jurisdiction
• You will not use our services for any unlawful purpose, including money laundering, fraud, or the financing of terrorism

4. Intellectual Property

All content, trademarks, logos, software, and materials available through Obseq’s website and platforms are the property of Obseq or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

5. Prohibited Activities

You agree not to:

• Use our services or website for any illegal or unauthorised purpose
• Attempt to gain unauthorised access to any part of our systems or infrastructure
• Interfere with or disrupt the integrity or performance of our services
• Misrepresent your identity, affiliation, or the nature of your business
• Use automated means to scrape, crawl, or extract data from our website without permission

6. SMS / Text Messaging Program

Obseq operates a non-marketing SMS/text messaging program for registered users with a verified mobile number. By providing your mobile number and consenting in the Obseq mobile or web app, you agree to receive (1) one-time verification/authentication codes when you request them, and (2) if you enable SMS under Settings → Notifications, transactional account and security alerts such as payment confirmations and security notifications. We do not send promotional or marketing text messages.

• Consent. Consent to receive text messages is not a condition of using Obseq or of any purchase. You consent by actively checking the consent box during phone verification and/or by enabling the SMS toggle in Settings → Notifications.
• Message frequency. Message frequency varies based on your activity and the alerts you enable.
• Cost. Message and data rates may apply, as determined by your mobile carrier and plan.
• Opt-out. You can cancel at any time by replying STOP (or OPTOUT, CANCEL, END, QUIT, UNSUBSCRIBE, REVOKE) to any message, or by disabling SMS under Settings → Notifications. After you opt out, you will receive a confirmation message and no further messages, unless you re-enroll.
• Help. Reply HELP or INFO for assistance, or email support@obseq.xyz.
• Privacy. No mobile information — including your mobile number and SMS consent — will be shared with or sold to third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.

Carriers are not liable for delayed or undelivered messages.

7. Disclaimers

Our website and publicly available materials are provided “as is” for informational purposes only. Nothing on this website constitutes financial, legal, or investment advice. We make no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any content.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Obseq shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of, or inability to use, our website or services. Our total liability in any matter shall not exceed the greater of USD 100 or the amount you paid us in the preceding three months.

9. Third-Party Links

Our website may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or availability of those sites. Links do not imply endorsement.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Dubai International Financial Centre (DIFC), United Arab Emirates. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the DIFC Courts.

11. Changes to Terms

We may update these Terms at any time by posting a revised version on this page. Your continued use of our website or services after changes take effect constitutes acceptance of the updated Terms.
